Terms of Service
Please read these Terms of Service carefully before using BinDash. By creating an account or
requesting service, you agree to be bound by these terms. If you do not agree, do not use the platform.
1. About BinDash
BinDash ("Company," "we," "us," or "our") is a residential bin-moving service operating in the
Phoenix Metro Area, Arizona. We connect homeowners ("Homeowners") with local service providers
("Runners") who move trash and recycling bins to the curb before collection day and return them
afterward.
BinDash operates through a web-based platform accessible at
www.bindash.org and
www.bindash.shop.
2. Eligibility & Accounts
To use BinDash you must:
- Be at least 18 years of age.
- Reside or own property within a BinDash service zone in the Phoenix Metro Area.
- Provide accurate, current, and complete account information.
- Maintain the security of your account credentials and notify us immediately of any unauthorized access.
You are responsible for all activity that occurs under your account. BinDash reserves the right to
suspend or terminate accounts that provide false information or violate these Terms.
3. Services Offered
BinDash offers the following service types:
Subscription Plans
- 1-Can Plan — Weekly Bin Out & Bin In for one trash or recycling can.
- 2-Can Same Day Plan — Weekly Bin Out & Bin In for two cans on the same collection day.
- 2-Can Split Day Plan — Weekly service for two cans with different collection days (e.g., recycling Monday, trash Thursday).
Bin Out As Needed (OAN)
- On-demand bin moving requested by the Homeowner when needed rather than on a fixed weekly schedule.
- Available in 1-can, 2-can same day, and 2-can split tiers.
- Includes a base monthly fee plus a per-visit charge.
À-La-Carte (Pay-Per-Visit)
- Individual bin runs booked one at a time with no subscription required.
- Charged per visit at the current posted rate.
- Requires a valid payment method on file.
All services include both a Bin Out (moving bins to the curb the evening before
collection) and a Bin In (returning bins after the truck passes) unless otherwise
specified.
4. Scheduling & Service Windows
- Bin Out runs are performed the evening before your scheduled collection day, typically between 6:00 PM and 9:00 PM.
- Bin In runs are performed after your trash truck has passed, typically between 8:00 AM and 2:00 PM on collection day.
- Exact times may vary based on runner availability, weather, or other operational factors.
- BinDash will notify you via SMS or app notification when your bins have been moved.
- Service is not guaranteed on officially recognized holidays. We will notify you in advance when holiday schedules apply.
Please note: BinDash is a best-effort service. While we strive for 100% completion,
occasional delays or missed visits can occur due to runner availability or unforeseen circumstances.
In such cases, we will contact you promptly and arrange a resolution.
5. Payment & Billing
- Subscription fees are billed monthly on your enrollment date via Stripe, our payment processor.
- À-la-carte and OAN per-visit charges are billed at the time the service is completed.
- All prices are in USD and inclusive of applicable service fees.
- You authorize BinDash to charge your payment method on file for all services rendered.
- Failed payments may result in temporary suspension of service until resolved.
- BinDash does not store your full card number. Payment data is handled securely by Stripe.
Current rates are posted at www.bindash.org and may
be updated with 14 days' advance notice to existing subscribers.
6. Cancellation & Refunds
- You may cancel your subscription at any time through your account dashboard or by contacting us.
- Cancellations take effect at the end of your current billing period. No partial-month refunds are issued.
- If BinDash fails to complete a scheduled service visit and cannot arrange a resolution within 24 hours,
you are entitled to a credit equal to one visit for that billing cycle.
- À-la-carte visits are non-refundable once the Runner has arrived at your property.
- Refund requests for extenuating circumstances are reviewed case-by-case and submitted to
support@bindash.org.
7. SMS & Text Message Communications
Important — please read this section carefully. By providing your mobile phone
number and creating a BinDash account, you consent to receive SMS text messages from BinDash
related to your service.
Types of messages you may receive:
- Service notifications — when your bins have been moved to the curb or returned.
- Route confirmation and completion alerts.
- Schedule change or delay notifications.
- Account and payment alerts.
- Emergency pickup confirmations.
Message frequency:
Message frequency varies based on your service schedule, typically 2–4 messages per collection day.
Opt-out:
Reply STOP to any BinDash text message to unsubscribe from SMS notifications.
You may also manage notification preferences in your account dashboard.
After opting out, you will receive one final confirmation message.
Help:
Reply HELP to any BinDash text message or contact us at
support@bindash.org.
Msg & data rates may apply. BinDash is not responsible for charges incurred
through your mobile carrier. SMS communications are provided by Twilio.
8. Runner Responsibilities
Runners are independent service providers who have been vetted and approved by BinDash. Runners agree to:
- Complete assigned bin routes fully and on time.
- Handle Homeowner property with care and respect.
- Not enter fenced areas beyond what is necessary to access bins, and to close gates after each visit.
- Report any property damage, access issues, or safety concerns through the BinDash app immediately.
- Maintain active status in the BinDash runner platform and respond to route offers within the designated acceptance window.
- Comply with all applicable local ordinances and traffic laws while on route.
Runners are independent contractors, not employees of BinDash. BinDash is not liable for the
actions, negligence, or omissions of individual Runners, except where otherwise required by law.
9. Homeowner Responsibilities
- Ensure your bin(s) are accessible on service day — not blocked by vehicles, locked gates, or other obstructions.
- Provide accurate gate codes, pet warnings, and access instructions during account setup and keep them current.
- Keep pets secured on service days so Runners can safely access your property.
- Do not place bins in locations that would create a safety hazard for the Runner or street traffic.
- Notify BinDash at least 24 hours in advance if you need to skip or modify a scheduled service.
BinDash reserves the right to pause or cancel service for Homeowners who repeatedly fail to provide
safe and accessible conditions for Runners.
10. Limitation of Liability
To the maximum extent permitted by applicable law, BinDash and its officers, employees, agents, and
contractors shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages of any kind.
- Missed or delayed service due to weather, natural disaster, or events beyond our reasonable control.
- Damage to property caused by the Homeowner's failure to provide accurate access information or safe conditions.
- Loss or damage to bin contents.
- Actions or omissions of independent Runner contractors.
Our total aggregate liability for any claim arising under these Terms shall not exceed the amount
you paid to BinDash in the 30 days preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be excluded under applicable Arizona or federal law.
11. Termination
BinDash may suspend or terminate your account at any time, with or without notice, if:
- You violate any provision of these Terms.
- You provide false or misleading information.
- Your payment method fails and the balance is not resolved within 7 days.
- You engage in abusive, threatening, or harassing behavior toward Runners or BinDash staff.
- Continued service creates a safety risk.
Upon termination, your right to use BinDash services ends immediately. Any outstanding balance
remains due.
12. Disputes & Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law
principles. Any dispute arising out of or relating to these Terms or BinDash services shall be
resolved first by good-faith negotiation. If not resolved within 30 days, disputes shall be submitted
to binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration
Association.
You waive the right to participate in a class-action lawsuit or class-wide arbitration related to
BinDash services.
13. Changes to These Terms
BinDash reserves the right to update these Terms at any time. When we make material changes, we will
notify you by:
- Sending an email to the address on your account, and/or
- Displaying a notice in the BinDash app.
Your continued use of BinDash after the effective date of any changes constitutes your acceptance of
the updated Terms. If you do not agree to the updated Terms, you must cancel your account.
